Minimal Requirements
In-use residential underground storage tanks less than 1,100 gallons are completely exempt from state regulations.
There are no state regulations that require in-use residential underground tanks to be removed. We have heard many "horror stories" from homeowners who spent thousands of dollars to remove an underground tank, only to find that the expense and disruption was unnecessary. While state laws and regulations treat underground storage tanks differently than above ground storage tanks located in a basement or outside a home, no law or regulation in Wisconsin requires the removal of a properly functioning residential heating oil tank currently in use. [Check with your individual municipality for requirements regarding underground tanks that are not in use.]
Basement storage tanks are, and always have been, completely exempt from all underground tank regulations.
